Last Updated: April 12, 2025
Introduction
At Bliss Water Care, LLC (the “Company,” “we,” “us,” or “our”), we are committed to protecting your privacy. This Privacy Policy explains how we collect, use and share your personal information when you interact with us through any of our services including our website, mobile application or our presence on third party marketplace platforms.
It also describes your choices and rights regarding your personal information and how we comply with laws such as the California Consumer Privacy Act (CCPA). By using our website, app, or other services (collectively, the “Services”), you acknowledge that you have read and agree to this Privacy Policy. If you do not agree, please discontinue use of our Services.
Information We Collect
We collect several types of personal information from and about you in order to provide our products and services. This includes:
Information You Provide Directly: When you engage with us, you may give us information such as:
- Contact Details: Your name, email address, phone number and shipping/billing address (for example, when you create an account or place an order).
- Account Credentials: If you create an account, we collect a username, password and other registration details.
- Order and Payment Information: Details of the products you purchase, order date and history and payment information. (Note: We use a third-party payment processor to handle credit card transactions securely, so we do not store your full card number or security code.)
- Communications: The content of any messages or inquiries you send us (e.g. via email or customer support chat) and your responses to any surveys or promotions.
- Optional Information: Any other information you choose to provide, such as product reviews, photos, or details about your pool/spa (if you voluntarily submit such information for customized advice).
- Technical Identifiers: Your IP address, device identifiers (such as device ID or advertising ID) and browser type/version.
- Location Data: General location information inferred from your IP address (e.g. city or region). We do not collect precise GPS location unless you explicitly grant permission via your device settings.
- Cookies and Similar Tech: We and third parties use cookies, pixels and similar tracking technologies to collect and analyze information like your preferences and interaction with our ads. (See Cookies and Tracking Technologies below for more details.)
- Usage Data: Details about how you navigate and use our Services, such as the pages or products you view, links clicked, time spent, search queries and referring webpage/app. In our mobile app, we may collect data on app usage, performance and any errors or crashes.
Information from Third Parties: We may receive personal information about you from other sources:
-
Marketplace Partners: If you purchase our products through a third-party marketplace platform, that platform will share with us the information needed to fulfill your order. This typically includes your name, contact information, order details and any delivery instructions. We use this information to process and deliver your purchase and may send back order status or tracking information to the marketplace.
-
Service Providers and Integrations: We could receive additional data from services we use. For example, our analytics providers (like Google Analytics) may give us aggregated insights about how users interact with our site, or our marketing partners might inform us if one of our campaigns led you to our store.
-
Social Media or Referrals: If you engage with our brand on social media (for instance, by tagging us or messaging us) or participate in a referral or loyalty program, we might receive your username, contact info, or other details from those platforms or programs. We will handle that information according to this Policy as well
We consider any information that identifies or relates to you as an individual to be “personal information.” You may choose not to provide certain personal data, but keep in mind this might limit your ability to use some of our Services (for example, we need contact and payment info to process an order).
How We Use Your Information
We use the personal information we collect for the following purposes:
-
Order Processing and Service Delivery: To process transactions and fulfill your orders, deliver products to you, handle returns or replacements and provide related customer support. This includes using your details to communicate with you about your purchase (e.g. order confirmations, shipping updates).
-
Account Management: If you create an account, to create, maintain and secure your account, including verifying your identity and enabling you to log in and manage your preferences or order history.
-
Communication: To correspond with you regarding any inquiries, requests, or customer service issues. We may also send administrative emails or messages related to your transactions or changes to our terms or policies.
-
Marketing and Promotional Messages: To send you newsletters, special offers, product updates and other marketing communications (via email or SMS) about our products or Services that we think may interest you. Note: We only send these with your consent or as permitted by law and you can opt out of marketing messages at any time (see Marketing Communications Opt-Out below).
-
Personalization: To personalize your experience on our website/app, such as recommending products tailored to your past purchases, showing content relevant to your location or interests and remembering your cart and preferences.
-
Analytics and Improvements: To analyze usage of our website, app and services (using tools like Google Analytics) in order to understand customer behavior and preferences. This helps us improve our offerings, develop new products/features, optimize user experience and fix issues. We often use aggregate or de-identified data for these purposes.
-
Advertising and Retargeting: To measure the effectiveness of our ads and deliver relevant advertisements. For example, we may use information about your visits to our site to re-target ads for our products on other websites or social media platforms. (This is done via cookies and ad pixels such as the Facebook Pixel, under the applicable privacy settings and consents.)
-
Security and Fraud Prevention: To protect our business and customers. For instance, we may use personal data to detect and prevent fraud, abuse, security incidents and other harmful or unauthorized activities. We also use it to verify transactions and ensure the integrity of our Services.
-
Legal Compliance: To comply with applicable legal and regulatory requirements and to respond to lawful requests, court orders and legal processes. We may use and retain personal information as necessary to fulfill our tax, accounting and record-keeping obligations, or to meet any reporting duties.
-
Enforcement and Protection: To enforce our Terms of Service and other agreements and to protect the rights and safety of our Company, our customers, or others. This includes using information in connection with the establishment or defense of legal claims.
- Other Purposes (with Notice/Consent): If we intend to use your information for a purpose not listed here, we will disclose it to you at the time of collection and, if required, obtain your consent.
We will only use your personal information in ways that are compatible with the purpose for which we collected it, or for closely related purposes. If we need to use your data for an unrelated purpose, we will notify you and, if necessary, ask for your permission.
Cookies and Tracking Technologies
Cookies are small text files that websites send to your device to store information about you. Tracking technologies like pixels, web beacons and mobile SDKs serve a similar function. We and our third-party partners use these tools on our website and app to ensure the Services work properly, to analyze traffic and to personalize content and ads.
Here’s how we use cookies and similar technologies:
-
Essential Cookies: These are necessary for our site to function. For example, they keep you logged in, remember items in your shopping cart and enable you to checkout securely. Without these cookies, basic e-commerce functionality would not work.
-
Analytics Cookies: We use analytics cookies (e.g., from Google Analytics) to collect information about site usage and performance. They help us understand things like which pages are most popular, how users navigate through the site and if users encounter errors. This data is generally aggregated and doesn’t directly identify you. It helps us improve the website’s functionality and your experience.
-
Advertising Cookies: Advertising and social media partners (such as Facebook/Meta) use cookies or pixels on our site to collect information about your browsing activities and interests. This allows us to provide you with more relevant advertisements on other platforms and measure the success of our advertising campaigns. For instance, the Facebook Pixel may log that you viewed a certain product on our site so that we can later show you an ad for that product on Facebook. These cookies may also enable features like social media sharing. We only use advertising cookies where permitted by law and you can adjust your preferences as described below.
- Functionality Cookies: These cookies remember choices you make (such as your preferred language or region) and provide enhanced features to improve your experience. For example, a functionality cookie might store your preference for certain types of products or your pool specifications (if you provide them) to customize content for you.
Your Choices for Cookies: When you first visit our site, you may see a cookie consent banner allowing you to accept or manage non-essential cookies. Regardless, most web browsers also let you control or disable cookies through their settings. You can set your browser to refuse cookies or to alert you when cookies are being sent. If you disable or delete certain cookies, please note that some parts of our site might not function properly (for example, the shopping cart or checkout).
For more information on managing and opting out of third-party ad cookies, you can visit industry websites such as the Network Advertising Initiative (NAI) or Digital Advertising Alliance (DAA) opt-out pages. Additionally, Google provides a browser add-on to opt-out of Google Analytics tracking and Facebook allows you to adjust your ad preferences in your user account settings. Keep in mind that opt-outs are typically device and browser specific.
“Do Not Track” Signals: Some browsers offer a “Do Not Track” (DNT) setting that requests a website not to track your online activity. California residents: please see California Privacy Rights below for information on the Global Privacy Control (GPC) signal, which we honor as an opt-out of certain data sharing under California law.
Sharing Your Information with Third Parties
We do not sell your personal information to third parties for money. However, we do share your information with certain third parties in the following circumstances, as necessary to run our business or as required by law. In all cases, we only share the minimum information needed and we require our partners to safeguard your data and use it only for the purposes we specify.
-
Service Providers (Processors): We share personal information with trusted third-party companies that perform services on our behalf. This includes:
-
E-commerce Platform: Our online store is hosted on Shopify. Shopify provides the web platform for our site and processes your order information (including payment details) on our behalf. They store data such as your account info and order history on their secure servers.
- Payment Processors: We use payment gateways to securely process your credit card and other payment transactions. These third parties receive your payment details to complete the transaction. We do not receive or store your full financial account numbers, aside from confirmation of payment.
- Shipping and Fulfillment Partners: We share necessary details (like your name and shipping address and in some cases phone/email for delivery updates) with carriers or logistics companies that deliver your orders.
-
Email/SMS Marketing Providers: We use an email and SMS marketing platform (for example, Klaviyo) to send our newsletters, promotional emails and text message offers. If you are subscribed to our marketing communications, we provide your contact information (such as email address and/or phone number) and certain marketing preferences to this platform to facilitate our campaigns. They may also process data about email open rates or link clicks to help us gauge engagement.
- Analytics and Advertising Partners: We use third-party analytics tools and advertising services to understand user activity and reach customers. For instance, we share data with Google Analytics (to analyze website usage) and implement the Facebook Pixel (which sends hashed identifiers and event data to Facebook/Meta to help us with targeted ads and measurement). These partners may receive information collected via cookies or similar technologies on our site (as described in the Cookies section). They act on our instructions to provide insights or advertising services and they are not allowed to use your data for their own unrelated purposes.
-
Subscription Management: If we offer subscription or auto-ship programs for products, we utilize a subscription management service (for example, Recharge) to handle recurring billing and order scheduling. If you enroll in a subscription, we share the relevant personal and payment information with that service to manage your subscription (e.g., to charge your card for each renewal and remind you of upcoming shipments).
-
E-commerce Platform: Our online store is hosted on Shopify. Shopify provides the web platform for our site and processes your order information (including payment details) on our behalf. They store data such as your account info and order history on their secure servers.
- These service providers are contractually obligated to protect your information and use it only to provide their services to us. We carefully select these partners and strive to only engage with reputable companies that adhere to privacy and security standards.
-
Marketplace Platforms: When you buy our products through a third-party marketplace (our “marketplace partners”), we receive your order information from that platform as described earlier. In turn, we may need to share some information back with the marketplace to fulfill and finalize your order. For example, we might provide the marketplace with the shipment tracking number, confirmation that your order was delivered, or information to handle any customer service issues. The use of your data by those marketplace platforms is governed by their own privacy policies – we recommend you review the privacy policy of the platform you used. Any information we receive from a marketplace is treated by us in accordance with this Privacy Policy.
-
Affiliates and Business Partners: If we are part of a corporate group, we may share your information with our parent company, subsidiaries, or affiliates for purposes consistent with this Privacy Policy. For example, if Bliss Water Care, LLC ever merges with or forms a subsidiary, your information might be shared within our corporate family to streamline services or customer support. Any affiliated entities will be bound to protect your information to the same extent we do. We may also share information with business partners when you have engaged in a co-branded offering or joint promotion, but only with your knowledge and, if required, your consent.
-
Legal Requirements and Protection: We may disclose personal information when we believe in good faith that such disclosure is necessary to comply with a legal obligation or request. This includes sharing information in response to lawful requests by public authorities (e.g., subpoenas, court orders, or government inquiries), or to meet national security or law enforcement requirements. We may also share your information to protect our rights, property and safety or those of our customers, our employees, or others. For example, we might share information with fraud prevention agencies or with law enforcement to investigate suspected fraud, harassment, or other violations of law or our policies.
-
Business Transfers: If we undergo a business transaction such as a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, your personal information may be disclosed to the acquiring or merging entity as part of due diligence or transferred to that entity as one of the transferred business assets. In such events, we will ensure that the recipient of your data commits to privacy measures that are consistent with those described in this Policy and we will provide notice before your personal information becomes subject to a different privacy policy.
- With Your Consent or At Your Direction: We will share your personal information with other third parties if you specifically request or consent to such sharing. For instance, if you ask us to share your information with a pool maintenance specialist to assist you, or if you opt-in to an offer from another company that we present, we will share your information as needed to carry out your request. Also, if you submit a product review or testimonial for publication, you are directing us to post your name (or other chosen identifier) and content publicly. In any case where you have given consent, you may revoke it at any time and we will stop further sharing going forward.
No Sale of Personal Information: We do not sell your personal data to data brokers or other third parties for their independent use. We also do not share personal information with third parties for cross-context behavioral advertising without your consent where required. In the context of CCPA, we do not sell personal information for money. We do engage in online advertising practices (like using cookies for personalized ads) that may be considered a "sharing" of data under California law; California residents have the right to opt out of this as explained below. Outside of those advertising-related uses, we restrict all third parties with whom we share data to using it solely to provide services to us or as otherwise described above.
Access, Update and Deletion of Your Information
You have the ability to access and manage the personal information you have provided to us:
-
Accessing and Updating Your Data: If you have created an account on our online store or app, you can log in to review and update certain personal details such as your contact information, shipping addresses and preferences. Please ensure your information is accurate and up-to-date. If any of your information changes, you may update it through your account settings or by contacting us. Even if you do not have an account, you can always contact us (see Contact Us at the end of this Policy) to inquire about the information we hold about you. We will provide you with appropriate access to your personal data that we have, subject to any legal exceptions (for example, if providing access would violate someone else’s privacy or if the data is legally privileged).
- Requesting Deletion: You may request that we delete your personal information. You can do this by contacting us with your request. Upon receiving a verified deletion request, we will remove or anonymize the personal information we have about you from our records, unless retaining it is necessary for us to complete a transaction you requested, comply with a legal obligation (for example, retaining purchase records for tax or warranty purposes), resolve disputes, enforce our agreements, or for other purposes permitted by law. We will inform you if we need to retain any data for such reasons.
-
Other Rights and Choices: In addition to access and deletion, you may have other choices under applicable law, such as the right to correct inaccurate information or to object to certain processing. We detail region-specific rights for California residents and individuals in the European Economic Area/United Kingdom in the sections below. However, we will do our best to honor requests from any customer regarding their data, regardless of residency, to the extent feasible and required by law.
To exercise any of these options or rights, please contact us via the methods provided in the Contact Us section. We may need to verify your identity (and authority, if you’re making a request on behalf of someone else) before fulfilling the request, for security reasons. Verification may involve confirming information we have on file or asking for additional information as needed.
Marketing Communications Opt-Out
We may send you marketing communications to keep you informed about new products, special deals, or other news about our company. These may include:
-
Email Newsletters and Promotions: If you sign up for our newsletter or provide your email during purchase (where permitted by law), we may send you periodic promotional emails.
- SMS/Text Messages: If you explicitly consent to receive text message alerts (for example, by opting in through our website or by texting a designated number), we may send you marketing SMS messages about promotions or updates.
Your choices for opting out:
-
Emails: You can unsubscribe from marketing emails at any time by clicking the “unsubscribe” link at the bottom of any promotional email we send. You can also request to be removed from our email list by contacting us directly. Please note that even if you opt out of marketing emails, we may still send you non-promotional messages related to your transactions or account (such as order confirmations, shipping notices, password resets, or customer service communications).
-
SMS/Text Messages: To stop receiving marketing text messages, you can follow the instructions provided in those messages. Typically, you can opt out by replying “STOP” to any promotional text we send. After you opt out, we may send one final message confirming your opt-out. Please allow a short time for your number to be removed from our SMS list. (Standard messaging rates may apply for any texts sent or received, according to your mobile plan.) If you have any issues opting out, contact us for assistance.
- Push Notifications: If you have our mobile app, we may send push notifications (for instance, about sales or new features) if you allowed them. You can disable push notifications at any time by adjusting the app settings or your device settings.
We will honor your opt-out requests as soon as reasonably practicable. You will not be charged a fee or penalized for opting out of marketing. Please remember that opting out of one type of communication (say, emails) will not automatically opt you out of another type (like SMS); please opt out of each channel separately if you wish to stop all marketing communications.
California Privacy Rights
If you are a California resident, you have specific privacy rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). These rights are summarized below and we honor them for eligible California residents. This section uses terms defined in California law.
Categories of Personal Information Collected: In the past 12 months, we have collected the categories of personal information described in the Information We Collect section of this Policy. This generally includes identifiers (like name, contact details, IP address, device ID), customer records (billing/shipping information, payment info), commercial information (products purchased and purchase history), internet or other electronic activity (usage data, cookies, interactions with our site/app) and geolocation data (approximate location from IP). We do not collect sensitive personal information such as Social Security numbers, driver’s license numbers, or precise geolocation coordinates, except for payment card information which is handled through our secure payment processor and not stored by us.
Your California Privacy Rights: As a California consumer, you have the following rights regarding your personal information:
-
Right to Know: You have the right to request that we disclose to you the personal information we have collected, used and disclosed about you over the past 12 months. This includes the specific pieces of information we have about you, as well as additional details like:
-
The categories of personal information we collected.
-
The categories of sources from which the information was collected (e.g., directly from you, from your device, from marketplace partners, etc.).
-
The business or commercial purposes for collecting or sharing that information.
- The categories of third parties with whom we shared or disclosed the information.
-
If applicable, the categories of information we “sold” or “shared” for cross-context behavioral advertising (note: We do not sell personal data for money and any sharing for advertising is described below).
-
The categories of personal information we collected.
-
Right to Delete: You have the right to request deletion of personal information we have collected from you and retained, subject to certain exceptions. For example, we may retain information needed to complete a transaction you initiated, to detect fraud or illegal activity, to exercise our legal rights, or to comply with legal obligations. If no exception applies, upon verification of your request, we will delete (and direct our service providers to delete) your personal information from our records.
-
Right to Correct: You have the right to request that we correct any inaccurate personal information we maintain about you. If you demonstrate that information we have is incorrect, we will take steps to rectify it as required.
-
Right to Opt-Out of Sale or Sharing: California law gives you the right to opt out of the “sale” of personal information or the “sharing” of personal information for targeted advertising purposes. As noted above, we do not sell your personal information for monetary compensation. We do engage in certain data sharing with third-party analytics and advertising partners (such as the use of advertising cookies and pixels) which may be considered a “sharing” of your information for cross-context behavioral advertising under CCPA. You have the right to direct us to stop such sharing. You can exercise this right by contacting us (see Contact Us below) with a request to opt out of targeted advertising. Additionally, if your browser or device is set up with a Global Privacy Control (GPC) signal, our website will treat that as a valid opt-out request for the device/browser encountering our site. We honor GPC signals in accordance with the CCPA regulations. (Note: GPC is a browser setting or extension that you can use to broadcast your privacy preference to opt out of data sales/sharing. Visit the GPC website for instructions on how to enable this setting if you’re interested.)
We also confirm that we have no actual knowledge of selling or sharing personal information of consumers under 16 years of age.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means we will not deny you goods or services, charge you a different price, or provide a different level of quality because you exercised your rights. (However, please note that if you ask us to delete your data, we may not be able to provide certain services that rely on that data. For example, deleting your account information will prevent us from recognizing you on a subsequent visit. But this is a direct result of your request, not a punitive action on our part.)
How to Exercise Your California Rights: If you are a California resident and wish to exercise any of the rights described above, you or your authorized agent can submit a request to us by emailing privacy@blisspoolcare.com or by contacting us through the methods listed in Contact Us. Please indicate that you are making a "California privacy rights request" and specify which right you seek to exercise. We will need to verify your identity before processing substantive requests (Right to Know, Delete, or Correct). This may involve matching information you provide with information we have on file and in some cases, we might request additional verification information. If you use an authorized agent to submit a request on your behalf, we will require proof of the agent’s authority and verification of your identity directly from you, unless the agent has a power of attorney in accordance with California law.
Once we receive and verify a valid request, we will respond within 45 days, or inform you in writing if we need more time (up to an additional 45 days). We will confirm receipt of your request within 10 business days and let you know if we need any further information to process it. There is no charge for submitting a reasonable request, though repeat or excessive requests may incur a fee as permitted by law.
For more information about your California privacy rights, you may also visit the California Attorney General’s website or refer to the CCPA and CPRA text. But we aim to make the exercise of your rights as straightforward as possible through the contact methods above.
Children’s Privacy
Our products and Services are not directed to children and we do not knowingly collect personal information from individuals under the age of 13 (or under 16 where applicable law provides additional protections to minors). If you are under 13, please do not attempt to register for an account or send any personal information about yourself to us. In the event we learn that we have collected personal information from a child under 13 without parental consent, we will take immediate steps to delete that information from our records.
Parents or guardians: if you believe that a child under your care has provided personal information to us without your consent, please contact us at privacy@blisspoolcare.com. We will work to remove the data and terminate any account if applicable.
We also do not knowingly “sell” or “share” the personal information of consumers under 16 years of age, as defined by applicable California law, without affirmative authorization.
Data Security
We take the security of your personal information very seriously. We implement a variety of administrative, technical and physical safeguards designed to protect your data from unauthorized access, disclosure, alteration and destruction. These measures include, for example:
-
Secure Browsing: Our website employs encryption via Secure Socket Layer (SSL/TLS) technology to protect data transmitted between your browser and our servers. This means that when you enter sensitive information (like payment details) on our checkout, the data is encrypted in transit.
-
Restricted Access: We limit access to personal information to those employees, contractors and service providers who have a business need to know it in order to perform their duties. All such persons are subject to confidentiality obligations.
-
Secure Infrastructure: We use reputable hosting and cloud service providers (such as Shopify’s infrastructure for our online store) that maintain high standards of security and certifications. Our systems are protected by firewalls and monitoring for vulnerabilities or intrusions.
-
Payment Security: As noted, we do not store full credit card information on our own servers. Payment data is handled by PCI-DSS compliant payment processors that specialize in secure payment processing.
-
Employee Training: Our team is trained on data privacy and security practices to ensure that they handle your information safely and respectfully.
- Procedures for Data Breaches: We have protocols to detect and respond to security incidents. In the unlikely event of a data breach affecting your personal information, we will notify you and the appropriate authorities as required by law.
Despite all these efforts, please be aware that no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee absolute security of your data. You share information with us at your own risk and it is important for you to also play a role in keeping your information safe. We encourage you to use a strong, unique password for your account with us and to keep it confidential. If you suspect any unauthorized access to or use of your account or information, please contact us immediately.
Data Retention
We retain your personal information for only as long as necessary to fulfill the purposes we collected it for, including to provide you with the Services and to satisfy any legal, accounting, or reporting requirements.
-
If you have an account or have made a purchase, we will keep your information for as long as your account is active or as needed to provide you with products and services.
-
If you make a purchase, we typically retain the details of that transaction for a period of time to handle any post-sale issues (like returns, refunds, or warranty claims) and to comply with legal record-keeping requirements. For example, we may need to keep records of sales for several years for tax and financial audit purposes.
-
If you participate in promotions or marketing, we retain your information until the promotion is over or until you opt out of marketing communications (and for a short period thereafter to comply with your request).
-
If you contact us with a question or support request, we may retain those communications and our response for a period, to ensure we have a history of your service inquiries in case of follow-up, or to train or improve our customer service.
- We also may retain certain data for longer if necessary to investigate or resolve issues, enforce our agreements, or comply with legal obligations. For instance, information that is relevant to a legal dispute or that is subject to a hold for litigation or government investigation may be kept until the issue is fully resolved.
When we no longer have a legitimate need or legal obligation to keep your personal information, we will securely dispose of it. This may involve deleting it, anonymizing or aggregating it so it no longer can be linked to you, or segregating it from active use. We take into account the sensitivity of the information, the volume and the potential risk of harm to decide on secure deletion methods.
Changes to this Privacy Policy
We may update or modify this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make a material change to this Policy, we will notify you by updating the “Last Updated” date at the top and, if appropriate, we may provide a more prominent notice (such as on our website homepage or via email notification). We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information.
Your continued use of our Services after any update to this Privacy Policy will constitute your acknowledgment of the changes and your agreement to abide by the updated Policy. If you do not agree with any updates or changes, you should stop using our Services and, if desired, contact us to exercise your rights (for example, to have your data deleted).
